Any person who is found in any public place under the influence of alcohol, drugs, or the combination of the two.
Public: any place that is clearly open to the public (restaurants, the street, the beach, etc.) or anywhere that is visible from a public area. This means that if your front yard is visible from the street, your yard is considered to be public in terms of this citation.
*If you have 5 or more people in your house, and there is a suspected party or gathering, cops are legally allowed to enter your home, as stated by the Social Host Ordinance

- Drunk enough to get this ticket: You are intoxicated to the point where you are in danger of harming yourself or others.
- Examples: Passed out in public; stumbling home; walking alone late at night with alcohol on your breath; walking with a group of people but you are clearly being held up by people in the group; vomiting in public; acting in an attention-grabbing manner that a sober person would not.
- Consequences: Jail for the night, a minimum of a $416 ticket, a mandatory court appearance and the requirement to take an alcohol and drug class, which is $60 ($165 for non UCSB students).
